Appeal Court Ruling: No Change To ADC Leadership, Party Urges Members Not To Be Misled

The African Democratic Congress (ADC) has said the Court of Appeal ruling in the ongoing leadership dispute within the party effectively leaves its current leadership intact, urging members and the public to disregard misleading interpretations of the judgment.

Party urges members not to be misled by misinterpretations of court decision.

In a statement signed by the National Publicity Secretary, Mallam Bolaji Abdullahi, the party explained that the appellate court dismissed the appeal on procedural grounds and did not issue any order affecting the positions of Senator David Mark as National Chairman and Ogbeni Rauf Aregbesola as National Secretary. The party therefore reassured members that its national leadership remains fully in place.

The full statement read:

The attention of members of the African Democratic Congress (ADC) has been drawn to reports concerning the recent decision of the Court of Appeal of Nigeria in an appeal filed by the National Chairman of the ADC, Senator David Mark, in connection with the ongoing suit instituted against the party leadership at the Federal High Court of Nigeria.

Having carefully studied the judgment, we wish to state unequivocally that the Court of Appeal did not determine the substantive dispute regarding the leadership of the ADC. The case challenging the emergence of Senator David Mark as National Chairman and Ogbeni Rauf Aregbesola as National Secretary is still pending before the Federal High Court and has not yet been heard or decided on its merits.

Importantly, the Court of Appeal did not grant any relief in favour of the plaintiff, nor did it issue any order affecting the leadership structure of the party. On the contrary, the court ordered that parties should maintain the status quo, meaning that the current state of affairs within the party should remain unchanged pending the determination of the substantive suit.

Members of the African Democratic Congress are therefore advised not to panic or be misled by misinterpretations of the judgment. The ruling of the Court of Appeal is purely procedural and does not affect the legitimacy or tenure of the current national leadership of the party.

The party remains united and focused despite the antics of anti-democratic forces bent on imposing a one-party rule on Nigeria.

Cubana Chief Priest: Why I Supported Obi Over Tinubu During 2023 Elections

Cubana Chief Priest has once again called on Igbo people to support President Bola Tinubu in the 2027 general elections.

Speaking at a recent City Boy Movement (CBM) rally in Imo state, the socialite admitted that he did not back Tinubu in the 2023 election because he wanted to identify as an “Igbo boy” supporting Peter Obi.

He described that decision as a “mistake” and referred to his past stance as “foolish,” stating that he has now reconsidered his position.

Cubana emphasised that “Igbo people are looking for a fair stake in Nigeria’s political arrangement and must be strategic with their votes moving forward”.

“At the past election, I did not support Tinubu because I wanted to be an Igbo boy by supporting Peter Obi and I made some careless mistakes. I was a fool then but not anymore now. We are just looking for a fair share in this government,” he said.

“We Igbos are the people that was defeated during the war and it has not been easy for us in Nigeria since then. That is why we want to be smart this time around so we can get what we want. We do not want to lose again and we will never wastes our votes again.

“That is why we are standing with City Boy Movement and Tinubu. Also they would not tell you that Seyi Tinubu married an Igbo girl. He is our brother and our own.”

In February, Cubana had called on the south-east to back Tinubu in the forthcoming elections, adding that he is hopeful that the president will hand over to an Igbo man at the end of his tenure.

The socialite was appointed as the Imo director of CBM, a youth-oriented support group for Tinubu’s re-election campaign.

Court Sentences Ekiti Lecturer Shittu Isiaka To De@th By Hanging For Armed Robbery

Court sentences Ekiti lecturer Shittu Isiaka to de@th by hanging for armed robbery. The court of appeal sitting in Akure, the Ondo state capital, has sentenced Shittu Isiaka, a lecturer at the College of Health Technology, Ijero-Ekiti, to death by hanging for armed robbery.

Omolara Adejumo, the presiding justice, delivered the judgement after finding Isiaka guilty of conspiracy to commit armed robbery and armed robbery.

John Joshua, the prosecution counsel, told the court that the incident occurred on July 5, 2017, along Ibuji on the Akure-Ilesha expressway.

Joshua said Isiaka and other accomplices – who are still at large – robbed Olatunji Olowoyeye, a commercial driver, of his Nissan Cabstar vehicle with registration number XJ 214 KTU at gunpoint.

While testifying, Olowoyeye told the court that he knew the defendant before the incident.

He said Isiaka and two other men had hired him in Ilesa to transport cocoa beans from Igbara-Oke for N20,000.

According to him, the men paid N8,000 upfront and promised to pay the balance after the trip.

Olowoyeye said he became suspicious when the passengers asked him to drive the vehicle into the bush near a primary school at Ibuji.

He told the court that one of the men sitting beside him suddenly brought out a gun while Isiaka sat in the front seat.

The victim said the attackers dragged him out of the vehicle, collected the key, his phone and cash, tied his hands and legs and abandoned him in the bush.

Olowoyeye further alleged that the defendant injected him with a substance before tying him to a tree.

According to him, he later rolled through the bush and reached the highway, where police patrol officers rescued him and took him to a hospital.

Olowoyeye told the court that he passed bloody urine for several days and spent about 15 days receiving medical treatment.

Kehinde Omotosho, an inspector and police witness, told the court that highway patrol officers brought the victim to the Igbara-Oke police station, where he made a statement implicating Isiaka.

During the trial, Isiaka denied the allegations.

The suspect told the court that he was not involved in the robbery and also denied injecting the victim with any substance.

The defendant argued that he was not a medical practitioner and had no licence to administer injections.

He further told the court that investigators failed to present any syringe or item allegedly used in the crime, adding that no medical report was tendered to support the victim’s claim.

In the judgement, the judge held that the prosecution failed to establish the offence of endangering life as required under section 135(1) of the Evidence Act.

The judge also noted that there were no eyewitness accounts of the alleged injection and no medical report to support the victim’s claim.

She said it would be unsafe to rely solely on the testimonies of the victim and another witness without any supporting medical evidence.

The judge consequently acquitted Isiaka on the third count but held that the prosecution established sufficient evidence linking the defendant to the robbery.

Adejumo convicted Isiaka of conspiracy to commit armed robbery and armed robbery, sentencing him to life imprisonment for conspiracy and death by hanging for armed robbery.

“The sentence of the court upon you is that you be hanged by the neck until you are dead,” the judge said.
